New Zealand politics in 2024

2023 was a year when New Zealand voters most adamantly said they wanted change. The near personality-cult around Jacinda Ardern had well and truly eroded, as the rhetoric around the government of “kindness” (implemented using the monopoly of legitimised violence of the state) and the budget of “wellbeing” (implemented by taking money from current and future generations) seemed increasingly empty. The government so committed to ending poverty had presided over the fastest increase in personal wealth by homeowners in modern history and its primary response was to tax landlords who didn’t want to rent out their properties for fewer than ten years without selling them.  It presented itself as a victim of external forces, whether it be Covid or inflation which NZ was constantly told was due to the war in Ukraine, even though many of NZ’s trading partners had lower inflation.

Although there was a brief flurry of excitement about Chris Hipkins, appearing to recalibrate Labour on “what matters”, voters were largely unconvinced. Hipkins follows Mike Moore and Bill Rowling in leading Labour to landslide defeats, albeit for different reasons. Jacinda Ardern is nearly invisible in the country that was hailed internationally for keeping Covid out, and she is now hailed internationally by those who never visited NZ, and she is now at Harvard, whose President Claudine Gay is surrounded by scandal around claiming that if a student of Harvard advocated for genocide against Jews, it would “depend on the context” as to whether it breached its policy on harassment and bullying. Claudine Gay is also now facing accusations of plagiarism in her earlier work.

The former Prime Minister of kindness hasn’t been approached for comment on what she thinks about the head of her new gig’s ambivalence about anti-semitism, but then again why would she abandon her career of highly-paid talkfests?

Meanwhile the 2023 election saw a threeway split in positions. While 27% were willing to give Chippy a go, 15% thought Labour had been far too timid and voted for the Greens and Te Pati Maori to advance a much more radical socialist, intersectionist, ethno-nationalist set of reforms including more tax, more spending, much more transfer of power from the state and Parliament to Iwi, and radical central planning around provision of health, education and the economy, let alone expansion of the welfare state to a universal benefit. 

The Greens and Te Pati Maori saw the changes as being that Labour didn’t do enough to address what it said it was doing about key issues such as climate change, poverty and Tino Rangitiratanga.  He Puapua was seen as a step along a journey of major constitutional change that would see Iwi standing side-by-side with Parliament and the “colonising” Government sharing power. Te Pati Maori successfully sold this vision to voters in almost all of the Maori seats, but Labour couldn’t sell the path of radical change to the general population, especially when questioning or criticising the path of more co-governance was simply labelled as racist and ignored.  

Fortunately around 55% (including some of the minor parties) voted in the other direction, with a mix of centre-right incrementalism (National), classical liberalism (ACT) and a touch of conservatism and nationalism (NZ First), with a couple of bones thrown at traditionalists.  It’s a historic switch in electoral support for Labour to lose 46% of the votes it gained in 2020 as a proportion of votes cast.  

The 2020 election was extraordinary, Labour got an unprecedented majority based almost entirely on having kept Covid 19 out of the country and life being relatively normal (albeit with foreign travel restricted for all but select politicians, officials and others chosen by the Government) compared to countries enduring extended lockdowns. Labour took that as a chance to embark on a series of radical reforms that ultimately saw its undoing. As it borrowed and spent to at first save businesses from collapse during the pandemic and then stimulate the economy, it went on to literally pay people money for nothing, and then blame inflation entirely on outside factors. As it increased benefits in order to address poverty (due in no small part due to a persistent housing shortage that can be blamed on governments of all stripes over the previous 25 years). it was no surprise that as baby boomers reached retirement age, a shortage of staff would emerge, as a generation withdrew from the labour force (bolstered by National Superannuation and inflated housing prices) and a growing number simply opted out of paid work altogether. Since 2017 the statutory minimum wage had been increased by just over 44%, even though prices in that same time had increased 25%. 

Reports of increasingly aggressive crime including ramraids were far too often dismissed or minimised, at least for those who were the victims of it, as it appeared that crime increasingly did pay.  Meanwhile, much needed reforms to the water sector had layered over them a complex governance structure that was to see Iwi, in four groups, deciding half of the members of boards, who would determine the members of another set of board, that would govern fresh, waste and stormwater infrastructure across the country.  This was all apparently because Te Tiriti now meant Iwi would have governance rights over whatever sectors the Government said it should – and infrastructure was now part of that.  It wasn’t enough for territorial authorities that own the infrastructure to consult with Iwi, not enough for there to be Iwi representatives on councils through exclusively Maori wards (which are democratically elected), but that Iwi would have equivalent powers to local government. Although some of the backlash against Three Waters was ill-directed mindless racism, the core issue – why should the future management of ratepayer owned assets be half governed by Iwi (who were already at the table of local government)?

Other completely unnecessary measures also gave the impression of a government less concerned about inflation and crime, than it was on social engineering and seeking to look as if it was addressing what it thought was important, when much of the public were concerned about the cost of living and threats to their families.

The aftermath of the Christchurch Mosque attack generated calls, particularly from parts of the Muslim community, to toughen laws on hate speech, primarily around religion. This raised concern that proposals advanced by the Ardern Government would constrain speech around ridiculing religions as “hate speech”.  Ultimately this was suspended, but it helped fuel a mix of genuine concerns around freedom of speech and conspiratorial concerns about a much more sinister intent.  Jacinda Ardern’s tone-deaf but well-meaning claim during the pandemic that if information “doesn’t come from us, then you can’t believe it” sounded straight out of the playbook of a dictatorship. No liberal democracy can or should claim it has the monopoly of truth, because it simply does not and cannot. 

The Public Interest Journalism Fund came from criticism that it was funding journalism that supported the Government’s policies, which although in some ways unfair, did include funding that specifically indicated a philosophical approach to some issues that was controversial, particularly around Te Tiriti. The lines between government and activism became blurred, including by the “Disinformation Project” which was clearly endorsed by the government, but which itself had its own ideological line.

The Disinformation Project of course has its own blind spots. It’s regular reporting of research by Byron Clark, former supporter of the Popular Front for the Liberation of Palestine (a breakaway communist led terrorist faction of the PLO) and the communist Workers Party of New Zealand, who was particularly focused on what he called the “far-right” didn’t ever reflect on the perspective someone clearly from the far-left would have on what is “extremist”. 

The 2021 controversy over the so-called “Listener 7” who claimed Matauranga isn’t science, and the long list of academics who sought to humiliate and denigrate them was also part of this dominant discourse in academia, media and politics. It was seen as an attempt to “cancel” and “close” debate on the topic, which extended to Dr Richard Dawkins in the UK, and responses claiming racism and colonialism emerged.  The debate around transgender rights, and the visit by “Posie Parker” supported by a coalition of womens’ rights activists and social conservatives saw similar discourse emerge, with a vehemence of anger and hatred.  All of this rubbed of on Labour, with a strong indication that there were opinions that brought “consequences” around employment and being accepted by academia, media and even business as having “correct” views on controversial topics. 

It's a side point that many of the same people who wanted “consequences” for challenging trans and Te Tiriti discourse run frightened when supporters of the Jewish community and opponents of Hamas condemn their Hamas-inspired rhetoric and slogans.

The majority of the voting public took in a mix of the narrative around the government, the cost of living crisis and concern about a lack of delivery (and performance personally about a growing list of Ministers who simply failed to meet standards of behaviour that should be expected of them).  ACT voters were dominated by those who had had enough of the growth in spending and taxation, and the politics of intersectionality and identity. National voters were primarily concerned about performance and lack of delivery, including the money wasted on expensive schemes seen as “out of touch” with what voters cared about. NZ First happily hoovered up the Covid 19 vaccine sceptics and opponents, but also returned to opposition to Maori nationalism and separatism and hitching onto other culture wars for convenience (see trans-rights).

There is now a National-led government that appears to clearly want to stem the growth in the state and, at the very least, return its size to that seen in 2017. It has clearly reversed some policies and is winding back reforms such as the centralisation of tertiary vocational training, the separate Maori health authority and Three Waters. Although some of the discourse around the government is catastrophism and projection of deranged phobia around its objectives (claims it wants to “erase” Maori or trans-people are unhinged nonsense), it is promising as a National-led government that actually is changing direction, which seems in part driven by ACT and NZ First both wanting to make their mark on the government. This should not be a surprise, as National did not win 40% of the vote, and is more dependent on both minor parties than it had been in the Key/English era.  There is also a generation of younger National, ACT and NZ First politicians who are fed up with a centre-right government simply pausing the advance towards more government and more compulsory collectivism.  

So far so good with most measures taken. It is obvious that Fair Pay Agreements had to go, along with the labyrinthine replacement to the RMA.  It’s particularly encouraging from an individual freedom perspective to see the removal of the tobacco prohibition measures, with much wailing and gnashing of teeth of neo-puritans on the left some who rightfully campaign to legalise cannabis but can’t see the inconsistency of prohibiting sales of tobacco to a growing number of adults.  We will wait to see what will come to replace the RMA.  

What I really want to see is for charter schools to flourish, to expand in number and for the thumping fist of the bureaucratic and professional union monopolies weakened in the control of the education system. I want the RMA replaced with private property rights. Nicola Willis has promisingly indicated willingness to cut core spending of many departments to 2017 levels, and for tax cuts.  

Of course, it wont be a libertarian government, but it looks like being a government that will turn back at least some of the spending and some of the regulation, and even some of the philosophical culture of the previous government. A government that is more interested in productivity and growth of private enterprise, rather than confiscation and distribution of the proceeds of production, and regulation and control of private individuals and their property. 

I can only hope that the calibre of Ministers will be on a significantly higher level than that of the Ardern/Hipkins era, and to be honest it wont be that hard. Nobody should pretend that it is easy to address crime or healthcare, because the fundamental reasons for both of this are long-standing and difficult to confront, but this government ought to focus on some key issues that it can start to turn around.  Educational choice and performance, and the barriers to enabling more housing.  If only it can adeptly take on the inevitable barrage of criticism from academia, media and the Opposition, who are eager to call it out as racist, misogynist, transphobic, white supremacist, neo-colonialist, neo-imperialist and every other blanket collectivist pejorative that can be lazily thrown around. Hopefully the front bench will have the testicular fortitude to respond intelligently and confidently to critiques, but more importantly give minimal reasons for criticism based on performance.

So in 2024 the National Party appears revitalised, and despite the critics, Christopher Luxon has emerged as Prime Minister, it is too early to tell whether the man as PM can prove to be greater than as Opposition Leader.  However, National might actually look like a government that isn’t conservative (in the sense of not changing) about Labour policies.

Labour is scarred, having few seats outside the main centres (Palmerston North and Nelson hanging on), and about to embark on a battle between the hardliners who think it lost for not being socialist enough (although if that were true, then those voters would have gone to the Greens and Te Pati Maori in sufficient numbers to give Labour a chance at government), and those who wonder how it could moderate its image and gain the confidence of voters again. For now, it looks like Labour will spend some time in the wilderness.

The Greens are buoyant because they have done very well indeed, winning two more electorates in Wellington, demonstrating very clearly the yawning gap between many Wellingtonians (including public servants, students and those working for industries supporting government) and the rest of the country, but maybe also the arrogance of Labour which thought it could parachute whoever it chose into two relatively safe seats, and win.  

ACT has a right to be pleased, because it will now have a more influential role in government than ever before. Hopefully it will be a greater success than Rodney Hide implementing Helen Clark’s vision for a greater Auckland Council, and it should enable ACT to stamp its mark on key issues such as education, gun regulation and freedom of speech.

Nobody rules out Winston anymore, as he pivoted and succeeded in being the voice for those who felt like their views, whether on Covid or Te Tiriti or on trans-issues, NZ First became the new conservatives, and a voice for those who felt unheard. The test for Winston Peters is whether he is seen as putting enough of a mark on this government to keep support for the following election. 

Finally Te Pati Maori will feel vindicated in reviving radical nationalist socialism with its support for the destruction of Israel and indifference to Russian irredentism. At best it showed Labour’s arrogance in assuming it still could own Maori voters, but at worst in indicates the outcome of many years of the promotion of intersectionality and structuralist theories in parts of Maoridom and by the state more directly. Labour funded and supported this philosophy while in government, and those who support it have found an authentic voice in favour of it – but it is not a position a majority of Maori, let alone voters in NZ, share.

The Islamofascist death cult of Hamas

The Palestinian Arabs got a raw deal from their leaders in 1948 when their neighbours decided the right response to the UK decolonising the Palestinian mandate by enabling the creation of Israel and a parallel Arab state was to oppose it.  You may or may not agree with the creation of the state of Israel, as an act of Jewish self-determination, but it was endorsed by the United Nations and has never been revoked.  For nearly twenty years neither Jordan nor Egypt, which held the Arab lands of Palestine enabled creation of a Palestinian state, indeed the concept of a "Palestinian homeland" was invented after 1967 - after the Six Day War when Jordan, Egypt and Syria tried to wipe Israel off the map - and each ended up losing territory to Israel.

It has all come a long way, in that Israel accepted Palestinian sovereignty over Gaza, albeit with power over airspace, marine and land access, by removing Israeli settlements in Gaza and withdrawing completely in 2005.  This gave the Palestinian Authority a chance to choose peace, build trust with Israel, and as a first step towards Israeli withdrawal from much of the West Bank, with the prospect of a land for peace deal, whereby Israel and the Palestinian State would exchange land to provide Israel with easily defensible borders. Of course the issue of Jerusalem remained most difficult.

However Palestinians in Gaza did not choose peace, they chose to break away from the Palestinian Authority and give power to Hamas - an Islamist death cult that by any objective measure of standards on the political spectrum would be deemed to be ultra-nationalist far-right fascist ultra-traditionalists. 

Hamas wants an Islamist theocracy, with no tolerance for other or no religion, no tolerance for political plurality. It promotes martyrdom to children, it promotes traditional submisive roles for women, it promotes death to homosexuals and lesbians and it promotes death to Jews. Its ideal is a totalitarian state of obedience to radical Islamism. It is a death cult, that celebrates the death of innocent people.  They are nihilists who are antithetical to any sense of life, to any belief that individuals exist to pursue their own purposes, their own lives, their loves, passions, interests and joy.  Hamas is in opposition to the values of the Enlightenment and the values of any liberal open modern society, let along liberal democracy. 

Hamas are enemies of Palestinians, they don't want peace for Palestinians and certainly don't want peace for Israel, they want it destroyed. They don't want "Palestine to be free" anymore than Beijing wants Taiwan to be free, or Moscow wants Ukraine to be free. 

There is plenty of room for criticism of Israel's treatment of the Palestinian occupied territories, and ultimately it will be right only when the Palestinian Arabs in the West Bank and Gaza can govern themselves in secular states with liberal democracy and no ability to wage war against their neighbours - and Israel respects their right to do so.  However, there will be no peace whilst Hamas thinks it is better to kill Israelis than to build an economy and society based on Palestinians producing, trading, living and thriving.  The most recent attack by Hamas was unprovoked, it has shown the vile horror of people who celebrate death and torture, of people who are the most vulnerable. By contrast you wont see the streets of Tel Aviv filled with people dragging women abducted from Gaza in horror.  That's the moral difference between a death cult and a society that has as base of human values. 

In the coming days we'll see who are the useful idiots to this death cult in New Zealand. John Minto is an obvious tan, but it was a surprise that the Minister of Foreign Affairs, Nanaia Mahuta issued her first statement which effectively called for both sides to stop:

"Aotearoa New Zealand is deeply concerned at the outbreak of conflict between Israel and Gaza. We call for the immediate cessation of violence. The protection of all civilians, and upholding of international humanitarian law is essential."

It blamed both sides. This was followed by a statement by PM Hipkins which condemned Hamas, followed by a similar statement by Mahuta. Does Nanaia Mahuta lack sympathy for Israel or have sympathy for Hamas? Or is she inept or does he just have a partisan advisor? We will probably never know. Both Christopher Luxon and David Seymour damned Hamas quite rightly alongside most of our allies, whereas the Greens condemned attacks on civilians, there are plenty of Green MPs who explicitly called out the slogan "from the river to the sea, Palestine will be free" - which is used by Hamas to mean wiping Israel off the map.  Meanwhile the clown show called the Wellington City Council voted recently for the city of broken sewers, crumbling library and town hall to become a sister city of Ramallah, which although under the authority of Fatah in the Palestinian Authority one-party state (not Hamas), is full of individuals cheering on attacks on Israel and the abduction of women and children.  That majority on Council includes the former Green Party Chief of Staff Tory Whanau - the Mayor - and the Green Party candidate for Wellington Central Tamatha Paul, who on recent polling stands a good chance of getting elected to Parliament by the Marxist morons in that electorate.

If you sympathise with Palestinians you will oppose Hamas. If you believe in individual freedom and human rights you'll oppose Hamas.  However, frankly, I have yet to see any semblance of an organisation set up by Palestinians that is actually about a relatively free open liberal democracy that resembles anything remotely like what exists in either Israel or other former dictatorships like Bulgaria or Georgia.

It would be wonderful for Palestine to be free, for there to be a Palestinian Arab state alongside Israel, that shares trade, investment, employment and lives in peace side by side. Some Israelis don't want that, they want the Greater Israel of the full occupation. A lot more Palestinians don't want that, they want the Jews pushed into the sea.  

Golda Meir once said "We will only have peace with the Arabs when they love their children more than they hate us", unfortunately too many of them want their children to be martyrs, and too many useful idiots in the West are happy to support them doing it.

UPDATE:  By the way, those voting in Christchurch Central, Auckland Central, Palmerston North and Mt Albert might ask why their Labour (for Christchurch Central) and Greens (for the rest) candidates who are all so vocal about the Palestinian issue previously are keeping quiet now?  

Of course it isn't just voters in those electorates it is ALL electorates, who might ask why Labour tolerates Duncan Webb belonging to a Facebook group that openly cheers on Hamas and anti-semitic rhetoric, and the Greens tolerate Teanau Tuiono doing the same, and then Chloe Swarbrick, Ricardo Menendez-March and Golriz Ghahraman who all cheer on Palestinian liberation.  

But you should ask more loudly what each of them think of Hamas's actions.  What they think of Hamas? What they think Israel should do when Hamas invades Israeli territory, invades civilians' homes and abduct women and children? What should Israel do when Hamas mows down young people attending a concert in Israel?  Remember this is Israeli land, recognised internationally, not occupied territory, it isn't land that anyone other than Hamas, Iran and other radicals who oppose the existence of Israel think should become part of a Palestinian state.

So go on? Ask those candidates.  Ask ALL Labour and Green candidates what they think. Marama Davidson went on a flotilla to Gaza after all. 

Oh and if you think that some of them aren't sympathetic, then do wonder why several Australian Green MPs have explicitly shown their support for Hamas - and of course the Green Party of Aotearoa always cheers on its colleagues over the Tasman.

Which party to vote for? New Zealand General Election 2023

I’ve been remiss in not offering my opinions on the political parties registered for this general election sooner, but I thought it was about time to do so.  I tend to spend a bit of time thinking about it, but basically it comes down to two sets of choices:

Parties that will on balance take away more freedoms, tax and regulate you more, and overall increase the role of state in people’s lives, and demote the role of the individual over politically-defined collectives vs;

Parties that will on balance increase freedoms, reduce tax and regulation, and overall reduce the role of the state in people’s lives, and increase the role of the individual over politically-defined collectives.

And:

Parties certainly or likely to be elected to Parliament vs;

Parties that certainly or almost certainly will not be elected to Parliament.

So below I have written an alphabetical review of each of the parties seeking to be elected under the party list, with a ranking of their likelihood to be elected to Parliament. My basis for review is whether the policies are libertarian, rational and whether the people behind it are to be trusted or ooze more turpitude than usual for politicians.

For those who can't be bothered reading so far, gere's my overall conclusion. 

Of the parties that are likely to get elected, ACT is the best of a fairly woeful bunch, and it’s primarily because of education policy and what looks like a bias towards less government. It’s far from consistent, and so much rhetoric is populist pablum, but it’s worth giving ACT its first chance to be the main supporting partner of National (which it didn’t achieve under John Key, as he could use TPM and United Future to get a majority). So, I’m reluctantly giving it a tick. Sure you could give National a tick instead, but it’s not a party that will move much towards less government and more individual choice and responsibility. It’s better than Labour, but that’s a low bar to cross. You could gamble with NZ First, but the idea Winston would pull National towards less government spending, less regulation and do anything substantial about pushing back against Maori nationalism is almost laughable.

If you don’t really care about a change in government you could vote for one of a few micro parties. Of them, the Aotearoa Legalise Cannabis Party is the most consistently libertarian because it has one policy, although it can’t organise itself to get close to being elected or indeed anything else. Of the rest, the New Conservatives might appeal to socially conservative classical liberals, but not libertarians. The other micro-parties are either blends of socialism with claims about freedom (primarily linked to the Covid vaccine, but also climate change and freedom of speech), or led by lunatics (Liz Gunn) or grifting shysters (Tamaki/Grey).

I will be hoping for a National/ACT government without NZ First, because it gives ACT its best chance to prove it can move the dial and make some substantial steps to implement reforms that are needed. 

In short:

ACT: Hold your nose and give a little less government a chance.

Animal Justice Party: Vegan fundamentalist nutters

Aotearoa Legalise Cannabis Party: Free the weed, but nothing else.

Democracy NZ: Conservative breakaway with an odd blend of anti-vax and anti-GMO, but it will fade away.

Freedoms NZ: Grifters Tamaki and Grey on their latest con.

Green: Blend of eco-authoritarians and commie post-modernists keen to sacrifice us all for the greater good, and if you don't like it why are you so full of hate and want the planet to burn and children to die?

Labour:  Union-tempered version of the above with a focus on much more gradualism.

Leighton Baker Party:  Pointless breakaway from the New Conservatives that is worse organised and is for social conservatives.

National: The anti-Labour party that primarily exists to obtain and hang onto power when Labour frightens or angers the public too much to stay in power, but only rarely and erratically reverses anything Labour does.

New Conservative: Social conservatism with some economic liberalism, yet with little to say about cutting state spending. A shadow of its former self having been decimated by the rise of multiple conservative micro-parties led by egos.

New Nation Party: Inconsistent unhinged blend of conspiracy, localism, lower taxes but more government spending. 

NewZeal:  Alfred Ngaro's conservatives for lower taxes but no plans for less spending. Why bother?

New Zealand First: Like dejavu Winston rises from obscurity to find new causes to advance, this time it's back to opposing racial separatism, transgender activism and to be tough on crime.  

New Zealand Loyal: Liz Gunn's mix of quackery and communism.

Te Pati Maori: Maori nationalist socialists

TOP: The party of clever leftwing policy wonks who aren't clever enough to work out how to get elected

Womens' Rights Party:  Feminist socialists against transgender post-modernism

The parties

ACT: Certain to get elected. Not at all a libertarian party, but the prime contender to pull a National-led government towards more freedom and less government. In its favour is a revolutionary approach to education, including decentralising roles and responsibilities, including what are in essence vouchers and charter schools for all. There is a tougher approach to welfare promoting individual responsibility, and what looks like a belief in significantly liberalising planning laws and a more rational approach to climate change policy. David Seymour’s rhetoric on reducing government waste ought to instinctively mean a reduction in spending, and a plan to lower and simplify income tax rates, although it is mild indeed compared with previous years. ACT is willing to take on the thorny issues of identity and governance around Te Tiriti, which has been ignored for too long. 

However, it is far from being all positive, the policies that are published are weak on some elements of economic liberalising. Water policy can’t suggest corporatisation, privatisation and user pays, but in fact is some bizarre blend of Muldoonism and its over-enthusiastic belief in PPPs (across far too many sectors). Sharing GST revenue with local government is also remarkably wasteful unless local government’s roles and responsibilities are pared back, otherwise the likes of Wellington City Council will just keep building or subsidising more entertainment and convention complexes. Those who rejected Covid vaccines, and the mandates and restrictions placed on people during the pandemic have fair reason to be disappointed in David Seymour’s comments during that period. Finally, it’s approach to personal freedom issues appears largely limited to legalising pseudoephedrine. It would be nice if it campaigned to reverse the absurd tobacco ban.  

There is a reason to support ACT, because no other party likely to be elected to Parliament will have MPs who, mostly, have instincts to put the state sector on a diet and to oppose Nanny State moves that National may just continue with.  However, it is entirely understandable why some might just find it too hard to swallow David Seymour’s pivoting on issues like housing intensification or vaccine mandates. For me, the number one reason to vote ACT is its education policy.  Education more than just about any other policy, is in crisis due to capture by bureaucracy and professional unions who want to take a monopolistic approach to how children should be educated. No other party can do something about this. I might be hopeful about reform of planning laws that could enable more housing, but I’m not optimistic about ACT on this. The cycle of politics in NZ is that ACT will likely peak at this election, especially if National is seen to do well by 2026, in which case this is the peak chance for ACT to effect real change. So on balance, a vote for ACT is defensible as a vote to give National a backbone on some issues.  8/10

Animal Justice Party: Certain to not get elected. Misanthropic lunatics with no chance of getting into Parliament. The party of mandatory veganism and those who want to equate domestic abuse between humans as the same applying to animals (including the emotional abuse of denying your dog its favourite toy – by the way you wouldn’t have property rights over any animal either). With policies to end animals in agriculture, it is fundamentally authoritarian post-modernist nonsense blending a benign hippie-level kindness with economic catastrophe and anti-scientific hatred of humans. The only good thing about the Animal Justice Party is it no doubt take votes away from the Greens, so go on and promote it among your more dull-witted Green supporters. 1/10

Aotearoa Legalise Cannabis Party: Certain to not get elected. The ALCP is just about legalising cannabis, so you could argue having one libertarian policy (and not wanting to increase the state’s role in anything else) means it is the purest libertarian party. You can’t be said to have “sold out” for voting for the ALCP, and for some legalising cannabis means more than anything.  A vote for the ALCP is making a statement about an issue most parties have chosen to ignore since the ill drafted referendum. However, it is just that one issue, and ALCP have little chance of getting in Parliament. Voting for ALCP indicates you rather don’t care about education, taxes, housing, environmental, economic or other policies.  These things matter so 6/10

DemocracyNZ: Certain to not get elected. Matt King’s breakaway party is a breakaway rural oriented conservative party. It prefers climate change adaptation to mitigation and looks to do little about reducing agricultural emissions beyond supporting scientific approaches towards doing so. It does seem to have a preference towards less regulation generally. It is in favour of more education choice and devolving some power. Otherwise, it is primarily about vaccine mandates, and parallels ACT and NZF on race issues. However, it does have an unscientific attitude to GMOs. The latter is irrational and odd. Still, it is likely to be relatively benign, except of course there is no plausible path to Parliament or even influencing it. It gets a 4/10.

Freedoms NZ: Certain to not get elected. Grifting megalomaniac Brian Tamaki and fellow grifter Sue Grey uses the word freedom, but freedoms are selective indeed.  Radical on lower taxes (but next to nothing on how to cut government spending), the big pushes are on compensating the vaccine injured. It claims to want to reject Nanny State but has very general statements about “better health and education. There is the touch of the conspiratorial here too, and it wholly rejects climate change and wants to significantly deregulate almost all regulation affecting the rural sector. Prosperity theology is grand-scale grift against the vulnerable and needy, and from a values point of view, someone who promotes this doctrine is not someone who believes in smaller government. Sue Grey in a different manner is a grifter of pseudoscientific nonsense, such as fear over 5G, and although I have respect for those who choose not to take the Covid vaccine, to talk of it being distributed as “genocide” says a lot about who is she and what she is about. This isn’t a party of freedom, it is a party led by confidence-tricksters who target the vulnerable.  It gets a 1/10.

Green: Certain to get elected. New Zealand’s party of socialism is the anti-thesis of more freedom, capitalism, belief in the human individual and less government. The Greens want more government, more tax (now targeting not just when you earn or spend money, but also just owning property), more regulation, more government departments, and with the exception of a less punitive approach to drugs (except alcohol), there is almost nothing for anyone who believe in freedom with the Greens.  The Greens are also in the frontline of promoting post-modernist concepts of identity defining people as privileged or victims based on immutable characteristics, and of course have little interest in private property rights. Note the Greens want Treaty settlements to include private land, wanting the state to decide that your home has to be bought by the state when you decide to sell.  This is also the party that is uninterested in helping Ukraine fight Russia, but happily puts front and centre candidates that chant slogans about wiping Israel off the map. The Greens after all carry the foreign affairs stance of self-styled “anti-imperialists” who don’t care about wars waged by anyone anti-Western including terrorists. Moreover, the Greens are at the forefront of wanting legislation on “hate speech” and are keen to define that based on who is speaking not just what they say.  A vote for the Greens is a vote to pass more power over your life, property and the community to the state.  It gets a 1/10

Labour: Certain to get elected. Green lite, full of people who wish they could go more socialist, go more identitarian, go more government, more taxes, more regulation, more bureaucracy, but know it wont win them power to do too much.  I mean why would you bother? It gets a 2/10. 

Leighton Baker Party: Certain to not get elected. If you’re going to have a personality led party, it needs to be a personality that enough people like and know. In Australia, Pauline Hanson and Bob Katter have done it, with constituencies big enough to justify it. For a start, it has three party list candidates. If it crossed the 5% threshold, it wouldn’t have enough candidates.  It’s a fairly standard conservative platform, with a few good points, like wanting charter schools, one law for all, enshrining freedom of speech and to ignore climate change mitigation. Yet it also wants direct democracy for decisions like tunnels? Baker is a conservative in the bedroom, and if you can’t rustle up six candidates on the tiny chance you get 5%, then why bother? It gets 3/10.

National: Certain to get elected. The party of free enterprise and individual freedom is generally very poor at advancing policies that reverse the statist policies of a Labour Government, let alone shrinking the role of the state even incrementally, when in power. At this election National’s big pushes are around minor tax cuts, some spending cuts, but a lot of new spending. It’s difficult to see its education policy breaking the bureaucratic/professional union monopoly on delivery and avoiding performance measurement, and likewise for its policy on planning to gut the post-RMA regulation of land use that hinders housing, supermarkets and other development. There does appear to be willingness to turn back race-based bureaucratic and funding measures, towards need, and to place more personal responsibility alongside welfare, as well as repealing the productivity-sapping “Fair Pay” measures. It would be generous to think National would turn the clock back to the spending and regulatory environment of 2017, let alone 1999. Yes voting National stops Labour getting in power, but it primarily stops the march to the left rather than reverses it much at all. You could do worse, but a libertarian would want a lot better.  6/10.

New Conservative: Certain to not get elected. The New Conservatives have clearly been gutted by the plethora of micro-conservative parties. There’s not really a lot here in economic freedom, some useful principles around property rights, but a bigger focus on family.  Although I’m more conservative on abortion than many, granting personhood to fertilised cells is not compatible with individual freedom.  There is a space for this party to represent socially conservative economic liberals, but there isn’t a lot that shows them to be economic liberals, especially a big pledge of lower taxes with nothing substantial on cutting spending. 5/10.

New Nation Party: Certain to not get elected. Starting with anti-privatisation rhetoric, there is an interesting range of positions. It wants a written constitution to protect freedoms, which is fine. Leaving the UN is conspiratorial nonsense (you don’t need to leave the UN to ignore what you don’t like).  It wants a $25,000 income tax free threshold, and no tax on benefits, superannuation or student allowances, but again no policies to cut spending except a generic “reduce powers of central government”. Sure, reinstating oil and gas exploration is fine, but more “provincial” powers is not compatible with more freedom. Then it wants to investigate decriminalising cannabis. It’s quite a mix of opposing He Puapua, more health spending, more funding for tertiary students and effectively defunding RNZ and the media generally.  I’m generous giving it 3/10

NewZeal: Certain to not get elected. Alfred Ngaro’s personal project. Another conservative party, but with a few weird policies like enabling housing deposits of only 2.5% for first home buyers. There is little interest in lower taxes and shrinking government, so the real question is why would you bother? 3/10

New Zealand First: On balance likely to get elected. Yes we do all know Winston, the indefatigable face of next generation Muldoonism. Winston put National in power once, Labour twice. He pivots between economic nationalism, anti-immigration and toughness on crime, and this time is opposing Maori nationalism and separatism in the way only Winston can. He is also waging war on “wokeness” which he discovered a few months ago, just under six years after he chose to govern with the blatantly woke Jacinda Ardern and the woke-ultras of the Green Party. The problem is this, I can believe Winston didn’t know He Puapua was being developed when he was a Cabinet Minister because he is fundamentally lazy.  He spends two years out of Parliament barely saying boo, and when he IS a Minister he’s happy travelling and having his name linked to a handful of policies. If you think Winston is going to change policies, then I have a bridge to sell you.  Winston is a populist opportunist who has three times in 27 years been given senior Cabinet positions (and his floxham and jetsam of followers) and there is no evidence it has made any substantial difference to economic or personal freedom.  Yes he might get in, but he is likely to slow down reforms than accelerate them, so 3/10.

New Zealand Loyal: Certain to not get elected. Liz Gunn’s unhinged party that is also incapable of getting enough candidates to be represented adequately if it reached 5%. It’s easily the most conspiratorial party of all, not only is it anti globalism, but it is hysterically environmentalist. It is keen on quack remedies and a financial transactions tax. Anyone talking about Covid response as a “mini-Holocaust” is not just hysterical but vile. It wants to nationalise all communications and energy, so this is no party of individual freedom, but a party of a deranged mix of authoritarian mysticism and hysteria. It’s frankly very sad.  0/10

Te Pati Maori: Almost certain to get elected. TPM has morphed in the past few years into Hone Harawira’s Mana Party, led in the background by a grifter only surpassed by Winston Peters, John Tamihere. The “genetically superior” Rawiri Waititi and the “Tangata Whenua, Tangata Tiriti or the racists” classifying Debbie Ngarewa-Packer have made the party into a radical Marxist nationalist party. On the bright side, there are elements of its belief in self-determination that would be compatible with a small state, it is also the only party that would decriminalise drug use and possession, but on the other side is a strong belief that NZers need to judged based on their classification. You’re either people of the land (Maori), people that are allowed to remain because of Te Tiriti (forget if you are born here and have no other citizenship), and everyone else who is “dying off” and doesn’t matter. TPM wants more tax, wants private land subject to Te Tiriti claims and Mana Whenua would have first right to buy private land up for sale. This is also the party that thinks all countries should be friends with Aotearoa, including the one attacking Ukraine and including the ones that operate literal Orwellian police states (e.g., DPRK and Eritrea). Neither Marxism nor nationalist identitarianism is good for individual freedom, nor can you expect tired old “anti-imperialist” apathy towards leftwing imperialism. TPM offers little for freedom lovers, but a lot for people who think Zimbabwe offers lessons to follow. 1/10

TOP – The Opportunities Party: Almost certain to not get elected.  TOP’s priorities are a greater welfare state (putting everyone on welfare), a broader tax base, more taxpayer funded healthcare and public transport, and the reinstatement of the Southerner train from Christchurch to Invercargill.  A party of clever people who think they know what’s best. The highlight is wanting to treat cannabis like alcohol, but you could vote for the ALCP and not have the universal basic income policy for people who don’t want to work. It has no interest in liberalising education and of course like the other leftwing parties, wants schoolchildren to be able to vote. It’s main value to freedom lovers is in denying Labour 1 or 2 seats, so go on get your leftie friends to vote TOP.  3/10

Women’s Rights Party: Certain to not get elected. Feminism that is now driven by being gender-critical around trans-genderism. There’s a place for that debate, and the Greens and Labour don't seem to want it, but everything else is just another socialist party for more welfare and more regulation. 2/10. 

Footnote:  I'll be interested to see how leaders of all of the parties respond to the war against Israel from the Islamofascist Hamas. Labour has already disgraced itself and National has shown backbone.

Bribing voters with their kids' money (and undermining your own policy objectives)

As a libertarian when a government cuts taxes I am pleased, even ones that are purportedly a user fee, because in fact so much of what is collected from those user fees is not directed to services consumed by the users - in this case fuel tax and road user charges.  It would, after all, be much better if the amount collected was what is needed to pay to maintain and upgrade the roads, rather than be directed to pet projects designed to "change behaviour" (subsidise transport modes you aren't willing to pay to use),.

However, it reeks of hypocrisy, as the Ardern/Hipkins Government proceeds to undermine a land transport funding system that once was seen as a shining example in a world where political pork barrelling is so often the order of the day (see Australia and the United States).  It's much more than that though.

Remember the "most transparent government ever"? Remember the commitment to (reducing) child poverty? Remember the belief that New Zealand taking action on climate change is meant to be a demonstrable commitment to values of environmental protection?

It's all bullshit of course.

Remember when Jacinda Ardern said tax cuts would STOP not cut, but stop investment (!) in health and education? This was when National proposed just to raise income tax thresholds, so inflation and wage rises wouldn't result in fiscal creep (when your increases in pay, to offset inflation) putting you into higher tax brackets.  

Remember when National proposed a cut in fuel excise, but Jacinda Ardern said it would mean the roads would fall apart?

"It maintains our roads and it builds our transport projects so if you were to remove excise, which every government has used, you basically remove your ability to maintain roads and build new roading projects," she told AM. 

It's all bullshit of course, because Labour did just that, it cut fuel excise and road user charges, and is paying for it by using "funds set aside for Covid" which are actually borrowings that are unspent.

Prime Minister Chris Hipkins is maintaining these cuts in tax through till the end of June 2023, not because fuel prices are high (they have been dropping for months), but because, he says, it relieves pressure on households.

Well it does, particularly higher income households. Infometrics research indicates that the highest income households save three times as much as lower income households.  That makes sense, as they pay the most fuel tax, because they drive the most and are likely to have the largest vehicles with the highest fuel consumption, but remember this is the Government that decried tax cuts "for the rich". 

Apparently it's ok to cut taxes for those that earn the most.... if Labour does it.

Transport Minister Michael Wood even said on Newstalk ZB that the tax cut was an "investment". Here's a clue, almost every single time a politician says something, that involves your money, is an "investment", it's a lie, because you'll never get anything back from it. In this case, Wood, known as a leftie in the Labour caucus, has helped us all out...

I agree with him, tax cuts are an investment - an investment in believing people know best how to spend their own money.  It was theirs in the first place. 

What's particularly hilarious is the contortion of the tax cut.  Ignore James Shaw bloviating that it is subsidising fossil fuels

It's bullshit.

For a start, it is cutting a tax, not subsidising the market price of fuel, secondly it is just one "fuel". Diesel doesn't carry excise tax, as diesel vehicles pay per kilometre to use the roads.  New Zealanders are still pay the market price for fuel, plus (for petrol) some fuel tax and GST.  However, you can rely on the Greens to exaggerate for hysterical effect.

After all fuel tax and road user charges do not raise money for general spending, but for the National Land Transport Fund, so that Waka Kotahi can spend money on roads, subsidising public transport and now Kiwirail and coastal shipping.  They are effectively user charges so there is some user pays, although it's worth noting what this government spends the money on, and how far it has undermined the system that was once deemed best practice by the World Bank.

69% of spending is on roads, the remainder is mostly spent on subsidising public transport and Kiwirail (26%), 4% on upgrading footpaths and cycleways and the remainder on administration and subsidies for coastal shipping.

Setting aside the 20% which actually isn't spent by the government, but comes from local government rates (on average half of spending on local roads and a bit less of public transport is from local government), 56% comes from road use fees in the form of tax on petrol, and road user charges on diesel powered vehicles, plus motor vehicle registration/licensing fees. 24% already comes from general taxes (either current or future).

By cutting fuel tax and RUC, Labour is substantially raising the proportion of money derived from borrowing from future general taxpayers, to around the same as fuel tax and RUC.  

Labour is now subsidising roads more than any government for decades.  Of course it is subsidising public transport like no government ever before, to the point that public transport users are now paying, on average, only around a quarter of the cost of paying for the bus driver and the diesel and maintaining the bus (or train). 

This is the same government that has an explicit target of cutting on average, 30% fewer km every year (50% if you live in a city) because it isn't just about climate change, it wants to mould you into a green citizen, that walks and bikes for most short journeys, rides public transport whenever it is available and just drive less. It's a centrally planned and controlled vision that doesn't respect people making the "wrong" choices, it is also supported by cutting speed limits, because it isn't just about safety, it happens to make driving less attractive compared to slower modes of transport.

However, Labour is now subsidising road use, and that includes road freight (note rail and shipping operators don't get any cut in fuel tax or road user charges, because they don't pay any, but they get subsidised anyway by other means).

So you have a Labour Government that says tax cuts (proposed by National and ACT) will threaten health and education.... but then implements tax cuts, completely blanking out the fact that this either means less money for other spending or it means more borrowing - for tax cuts.  How "sustainable" is that?

It says tax cuts will benefit the rich the most, and then implements tax cuts that do just that.

It says cutting fuel tax will jeopardise spending on transport, and then implements tax cuts on fuel.

Finally, it claims climate change is the great crisis that especially needs New Zealand, the country that emits 0.09% of global CO2 emissions  must radically change how it lives, by constraining private motoring, but then subsidises road use like no government in recent history.

Votes are much more precious that policy objectives though, as is leaving a fiscal bomb for the other side if the election is lost, although if it were up to me, the next government could think long and hard about whether it subsidises public transport and rail from general taxes anyway (assuming it wants to do that), and leaving fuel tax and RUC for roads only.

Ardern's legacy isn't kindness

It's been over a week, and it's remarkable that Jacinda Ardern has simply disappeared from the politics of a country she exercised almost unprecedented levels of power over, for the previous few years. The (leftwing statist post-modernist identitarian) world has cried out "why", and far too many have come to the conclusion that it's no doubt sexism (in the country that gave her the greatest electoral mandate of any Prime Minister since 1951, and had previously had two female Prime Ministers).

However, Ardern's resignation appears on the face of it to reflect two things:

  • Fatigue from someone who isn't intellectually or emotionally able to handle the time and the stress of the position
  • Fear of an election campaign during which scrutiny will be its highest and the chance of defeat the strongest yet.
She is, after all, an almost accidental Prime Minister. She wasn't expected to become Prime Minister after the 2017 election, as National was so well ahead in the polls, it's just that National had "spent" its coalition/support partners over previous terms, and so angered Winston Peters that he chose to swing left.

Of course in this neo-identitarian political age (a variation on classic chauvinistic identitarianism), Ardern's age and sex were notable as an "achievement", enhanced by her clearly being someone who never seemed to covet the role (which is now born out by her fatigability), made her a darling of international media.  The Anglosphere in particular is dominated by mono-linguistic types who pay little attention to the likes of Sanna Marin, the Finnish (young female) Prime Minister who chose to ignore the wrath of Vladimir Putin and seek Finland's membership of NATO. A position of courage, and not remotely a position the likes of Ardern (or indeed Hipkins) would ever take in foreign affairs, as New Zealand's foreign policy since the Lange age has been to be largely weak against those that challenge Western countries (see, for example, how pathetic Ardern/Mahuta were in response to China's trade sanctions against Australia). 

Ardern was notable for embracing an explicitly sympathetic and emotional image to leadership, and for declaring how kindness in government is a virtue. This is extraordinary from a politician who has led a government that, by and large, has sought to take more of people's money, borrow more from future generations and to direct and centrally manage and control more intensely than any government since the Muldoon era. 

I suppose Ardern will regard the generosity of her government with welfare benefits to be "kindness", which of course is really kindness with other people's money.  That "kindness" certainly will have relieved some poverty, but also contributes towards a dependency on other people's money, and the labour shortage that has emerged since the end of Covid restrictions. Lindsay Mitchell has written eloquently on this noting that the number and proportion of people receiving a main benefit at the end of the last six December quarters is up 22% compared to when Ardern first became Prime Minister.  New Zealand has both a critical skills shortage, a restrictive approach to immigration and is generous to those who don't want to work, but Ardern can't connect the dots.  At no point has this government noted that being too "kind" with other people's money encourages people to be economically idle.

The reality of the "kindness" narrative is no joke to the victims of ramraid attacks, and the growth in crime, because the "kindness" is interpreted as there being an easy ride for perpetrators.  The fact so many of the victims are recent migrants who own businesses is a community that maybe sees less kindness in the rhetoric, particular the notion that the reason some young people drive cars to steal stuff is claimed to be poverty, rather than opportunistic nihilism.

Another group not feeling the kindness includes immigrants who invested time and money into New Zealand and have been told to fuck off back home leave.  The former owners of Tennyson Cafe in Napier, who migrated from France, poured $600,000 into the business, brought their children over and had to meet financial targets for the business to get permanent residency.  The pandemic, of course, got in the way, and they failed to meet the targets.

The family’s first year in Cafe Tennyson and Bistro did not go as well as hoped, but the year ended March 2020 was much better and boded well.  The Debords invested more than $600,000 in the business, and the kids Lisa, 10, and Thibaut, 12, had settled in and were thriving at a local primary school. For the past two years, while other cafes around them have closed and laid off staff, the Debords have battled on.

Immigration NZ said because the didn't meet their targets (regardless of reason) they could not be allowed to remain, local MP and Cabinet Minister Stuart Nash supported them, but of course these were the rules set by the government he is a part of and Ardern led. So imagine a family, relocated halfway across the world, setting up a successful business, contributing financially and personally to a community, being told by an unproductive minion of the burgeoning Ardern state to leave.  Claims that it was an administrative decision is ludicrous in the context of a government with a majority able to change the laws to address such discrepancies.  For someone who gained her mandate due to handling of the pandemic, it is a curious blind spot that Ardern literally couldn't care less about people from overseas who contribute demonstrably to New Zealand, being allowed to stay. It's something that foreign fans of Ardern wouldn't believe, because they think she's the antithesis of "Trump" and everything they hate, when in fact she's led a government highly sceptical of immigration, not least because of a strong streak of Maori caucus antipathy towards immigration (and trade union dislike of people who represent competition for their members - this is the left treating individuals as economic units - something that is often decried).

The legions of people who couldn't get home during the pandemic, whereas various minstrels, thespians, clowns, ball players, politicians and businesspeople were given special access to MIQ, was also the other side of the "kind" government, that granted special privileges to those who ticked the right boxes.  Ardern led a government of "pull" as Eric Crampton wrote about.  Ardern's Government was kind to the "right" kind of people, such as people working in horse racing, international film producers, America's Cup syndicate employees, minstrels performing and businesspeople with stands at the Dubai Expo.  Average New Zealanders don't have that sort of "pull".

Then there are the Afghans who helped New Zealand forces not getting automatic visas to move to NZ after the Taliban took over.  What could be less kind that for people who worked with foreign forces not being granted residency when their psychopathic totalitarian enemy takes over?  However, the Ardern Government's attitude to foreign policy was more about signalling virtue than substance.  Calling for a ban on nuclear weapons is the sort of naive student politics that demeaned Ardern, as was calling climate change her generation's "nuclear-free moment". Then again if she meant New Zealand taking action that would have no impact on a global issue or problem (which is what the nuclear ban achieved) then she might have been right.

A lot of money has been spent by the Ardern Government, yet the performance of public services continues to be woeful, not least because the incentives of prioritising the interests of vocal professional unions are not on consumers of those services.  The DHB model was poor, but centralised healthcare is unlikely to deliver innovation or pressure for efficiencies.  On education, the desire for more centralisation is clear, as diversity in education delivery is an anathema to a government full of sympathisers to teachers' unions.  The Ardern Government doesn't want parents directing schools when it has grown the educational bureaucracy in Wellington so much.

That's been the other effect, the massive growth in the Wellington bureaucracy more generally.  A 38% increase in policy analysts, a 43% increase in managers and 56% increase in information professionals reflects a bloating demand by the Ardern Government for regulatory and policy work, and little of it is about getting the state to do less, but rather to do more.  It's part of her belief system in an activist state, but this philosophy hits the reality that you can't make a lot of things "better" by just throwing more public servants at it to analyse what to do, especially since whole ranges of options are completely ruled out politically. It's telling that the Ardern Government wouldn't even look once at commercialising water, even though it has been somewhat of a success in Auckland (for fresh and waste water only), because it is only interested in options that centralise power.

Then there is whole issue of "co-governance" which means that Iwi are treated as equals in government to central and local government, and given power to choose their own people to sit alongside those chosen by election (who are ALSO chosen in part by those selecting Iwi representatives).  It also means abolishing one-person one-vote, as nearly happened in Rotorua.  The fact the Ardern Government is so willing to consider abolishing a core tenet of liberal democracy to placate Maori nationalists is far from kind. Finally Ardern's concern about freedom of speech being a weapon and wanting to suppress disinformation presents an overly confident view of the state benignly suppressing what is "bad", without suppressing what is good or even useful.  It is understandable that she is keen to see less rhetoric that supports the likes of the Christchurch shooter or those claiming conspiracies for all sorts of issues, but her inability to see the importance of freedom of speech created plenty of justifiable criticism.  Her philosophy feeds into the rhetoric of dictators from China to Russia to Nigeria to Venezuela, who simply call criticism "disinformation". 

The narrative now being conveniently trotted out about Ardern is the abuse she receives from critics, and certainly no one can justify threats of violence against her and her family.  Yet her main opponent in 2020 was Judith Collins, and abuse of her is largely brushed to one side, and of course many of those who decry abuse of Ardern are more than happy to tolerate abuse of male politicians as Graham Adams wrote in The Platform.  I'm old enough to remember the constant references to Robert Muldoon as "piggy", and the idea that somehow people shouldn't be able to throw pejoratives at women in power any less than men is rather chilling.  People have the right to call their leaders names and be rude about them, even if it is puerile and they don't like it, what they don't have the right to do is to threaten them. Ardern undoubtedly gets some nasty threats, and different ones from men because she is a woman, but it's intellectually lazy polemics to claim that the country that granted Ardern a remarkable mandate in 2020 is also dripping misogynistic hatred of women in power (despite having also granting a mandate for Helen Clark to govern for nine years), when hatred of men in power is just brushed over as part of the game.

It's good for Ardern to give up, nobody should be in the job if they find it too difficult, but just over a week on, and it is clear that Hipkins has just tweaked the dials, and done little other than give the impression he's a bit less woke-authoritarian, and he's more than willing to extend unfunded tax cuts (fuel tax/RUC discount) and say he's "reviewing" policies that Ardern and her whole government were dead keen on hanging their hats on.

What the polls suggest is that the politics of "kindness" were seen by enough of the public to be empty of substance, but it also suggests that Christopher Luxon has a fair way to convince people that his alternative is one of substance.

A key question will be whether a National-led government is actually going to embark on the sort of reforms needed to turn back the tide on the growing centralising state, and incentivise individual responsibility, entrepreneurship and freedom of choice,

Climate change and agriculture

I accept there is anthropogenic climate change, and there is going to be an ongoing process of reductions in emissions due to improvements in efficiency and technology.  Because New Zealand has such a low population relative to its production of agricultural commodities, emissions from agriculture are high per capita, compared to virtually all of its trading partners.

As a result, the agricultural sector will have to be a part of that, and New Zealand should be expected to cut emissions along with the rest of the world. 

However, most of New Zealand's agricultural production is exported, and export markets for agricultural commodities are heavily distorted by a mix of high subsidies, tariffs and other import barriers from major economies, specifically the European Union and the United States (Japan as well, but that affects the rice market).  As New Zealand's market is both open to imports and there are few subsidies, New Zealand exports effectively because it is an efficient producer, which also happens to have some of the lowest emissions per tonne of production in the world.  One study indicated that for lamb, New Zealand emitted 688kg of CO2 per tonne produced and imported to the UK, compared to 2849kg of CO2 for UK produced lamb. 

So let's paint the picture. New Zealand farmers, located further away from most markets than any other producers, compete on a global market, a market heavily distorted by import quotas (restricting how much New Zealand farmers can sell), tariffs (taxing their products but not taxing domestic producers) and subsidies (undercutting the higher cost of production). If there were largely a free market for agriculture, similar to many manufactured goods, then inefficient producers (that use more energy and emit more CO2) would be out of business or would need to improve efficiency.  

However there is not. There were some tender attempts by the Bush Administration to get rid of export subsidies for agriculture, if the EU also agreed, but this all faltered, and since the Obama Administration there has been little to no interest from the US in multilateral trade liberalisation (and the EU has never been keen on liberalising agricultural trade). 

For New Zealand farmers to face payments for emissions on a scale or in a manner that undermines their export competitiveness is likely to have several effects:

  • Reducing the scale of New Zealand agricultural production 
  • Increasing the price of commodities New Zealand exports
  • Increasing the production of LESS efficient and HIGHER emitting producers that are heavily protected and not required to pay for emissions.
In short it risks exporting emissions, by shifting production to other economies.

The most generous view of this is it is futile. It buys virtue signalling from unproductive multi-national lobbyists like Greenpeace and enables Jacinda Ardern and James Shaw to claim they are "world leading", but the savings in emissions get replaced by higher emissions from elsewhere. When New Zealand reduces production, others will sell to those markets instead, at a slightly higher price, but with higher emissions and less economic efficiency.  The least generous view of it is that it is economic treachery.  It harms a local industry to ineffectively achieve a policy objective.

It would be quite different if Ardern and Shaw went to Brussels, Washington, Canberra et al and argued that New Zealand will charge for methane emissions if THEY will, and if THEY will introduce measures to reduce emissions in agriculture that at the very least do not distort international trade in agricultural commodities any more than their existing protectionist arrangements.  It presents options that show New Zealand is willing to move if they are as well.

Sure, whatever New Zealand does on emissions will make ~0 impact on climate change, but if there is going to be action on emissions New Zealand has to join in, or it faces the likelihood of sanctions from several major economies. What matters though is this small economy does not kneecap its most productive and competitive sectors in order to virtue signal.  

Of course there are plenty who hate the farming sector, either because of what they produce and who they vote for, and the Green Party thinks agriculture should go all organic, produce LESS at HIGHER prices, and you can imagine the impact of this on the poor (but the Greens think they can tax the rich to pay for everyone).  They are very happy to spend the tax revenue collected, but treat it as a sunset industry.

So sure, agriculture needs to be included, but there needs to be a Government that doesn't want to shrink the sector in which New Zealand has the greatest comparative advantage.

What does the future of co-governance look like?

Power without being elected

With the impending passage of the Canterbury Regional Council (Ngāi Tahu Representation) Bill, New Zealand will have taken a giant leap in the direction of reducing democracy in local government. It's important to be very clear about what this means:

  1. Ngai Tahu will appoint two members of the Canterbury Regional Council (known as Environment Canterbury), they will sit alongside and have identical powers to elected members
  2. Ngai Tahu members will be selected by Ngai Tahu by whatever means Ngai Tahu deems appropriate
  3. Those councillors will have full powers to vote on spending, on taxes (rates), on buying and selling assets and on bylaws.
  4. No electors in Canterbury region will be able to remove Ngai Tahu representatives (except of course, those with authority in Ngai Tahu), includes those affiliated with Ngai Tahu who do not have influence with the iwi.
It's very important to recognise what government, including local government actually is. 

Government is an institution with the monopoly of legalised use of initiated force against people and their property, and it devolves some of that power to local government. 

Environment Canterbury has such powers, powers to forcibly take money in the form of rates and to levy the public for services, it has powers to make bylaws and has powers to constrain the use of property. 

In a liberal democracy the constraints on that power come in two forms:
  • Legislative constraints (as local government is constrained by legislation and regulation);
  • Local democracy (the ability to vote out and replace Councillors who exercise these powers).
Parliament has chosen to weaken the ability of Canterbury electors to do the latter.  The key element in a free liberal democracy is more the ability to peacefully remove people from power than to select those that exercise power, but this legislation removes the right of Canterbury electors to remove two councillors.  Indeed, those councillors are only accountable to those with power in Ngai Tahu, not electors at large.

This is literal corporatism, in which a corporate private entity exercises direct political power, with there being no effective means of removing them (except of course if Parliament changes the law to abolish their position).

Bear in mind there is nothing stopping Ngai Tahu proposing candidates for election now, or funding and supporting the campaign of candidates it approves of, but it doesn't believe that would be successful.  

Bear in mind also that members of Ngai Tahu who are Canterbury electors retain the power to vote for Councillors, they have that power now, but they will also have some influence (it could be a lot or it could be negligible) in the selection of unelected councillors.  Members of Ngai Tahu who are Canterbury electors get two chances at selecting councillors.

Some may say sure but non-resident ratepayers get a vote too. Yes they do, but it is a vote and if they were residents as well, there would still only be one vote. There are sound arguments either way about non-resident ratepayer voting rights, but that is a separate issue.  Note that there are plenty of people affiliated to Ngai Tahu who are not electors in Canterbury too.

Where next?

There are  other examples that have parallels to Canterbury.  The Rotorua District Council (Representation Arrangements) Bill, would have generated higher Maori representation on that Council than their proportion of the population.  David Farrar ably demonstrated how unjust that would have been, as each Maori ward councillor would have represented far fewer people than a non-Maori ward councillor.  The Bill was dropped  in part because the Bill of Rights assessment said Maori wards would have disproportionately higher representation. 

Wellington City Council took it upon itself to include two mana whenua representatives on Council Committees (not full Council). One each from Taranaki Whānui ki Te Upoko o Te Ika and Ngāti Toa Rangatira sit on all Council Committee with FULL voting rights. It justified the idea as contributing towards decision making, but this is frankly absurd.  Having voting rights for unelected councillors (which is effectively what it is) is more than "contributing" it is exercising power.  The representatives also get reimbursed by ratepayers, "by paying each iwi an annual fee, equivalent to the remuneration of a full time elected member, which is currently $111,225".  So ratepayers get to pay for representatives they cannot vote for or against, that exercise power over them.  6 Councillors voted against this nonsense, namely Mayor Foster, Councillor Calvert, Councillor Rush, Councillor Sparrow, Councillor Woolf, and Councillor Young. However, the majority prevailed (Councillor Condie, Councillor Day, Councillor Fitzsimons, Councillor Foon, Councillor Matthews, Councillor O'Neill, Councillor Pannett, and Councillor Paul).

Noting this already happens for Rotorua Lakes District Council, it has iwi representatives with voting rights on Council Committees.

What would need legislation is to enable full Councillors to be appointed by iwi rather than be elected by electors. 

It seems highly likely that the Labour Government, with full support from the Greens and Te Pati Maori, would endorse local government having appointed (not elected) City, District and Regional Councillors, with the rights to vote on your rates, bylaws, spending, sale and purchase of assets and planning rules.

Let's be clear this is NOT the same as Maori wards. In principle, if a Council wants those on the Maori electoral roll to have Maori ward councillors, as it is for Parliament, it does not undermine democratic accountability. Maori electors shifting from general wards to Maori wards changes their representation, but they are still elected and accountable to electors.

Having iwi choose representatives is the same as having any large private interest choose representatives on Council. Councils exist to provide certain public goods and services, but also to regulate activity including planning activity.  Iwi themselves have substantial commercial and property interests.  Consider if Councillors (as some do) have large property or business interests in a district, they are at least accountable to electors, but the iwi representatives are not.  

So could Labour, the Greens and Te Pati Maori require all Councils to have unelected Mana Whenua councillors? Of course.... but could it go beyond that?

Iwi selected MPs?

Te Pati Maori Co-Leader Rawiri Waititi has already expressed his contempt for democracy as being the tyranny of the majority. Now I SHARE this concern, which is why I want the power of government limited, but I don't share his objectives or solution, or his perception of the problem. He wants a separate Maori Parliament which would decide on matters for Maori, although does not explain how that would work in practice.  

Applying the principles of the Canterbury Regional Council (Ngāi Tahu Representation) Bill to Parliament would mean that all iwi would be able to appoint MPs to Parliament (perhaps with some proportionality? or perhaps each being equal?) to have the same voting rights as elected MPs (which Maori would continue to be able to vote for).  

That would make Aotearoa/New Zealand far from being a liberal democracy, as Parliament would be dominated by entities that themselves determine how to select people to exercise legislative power over people and their property. 

This isn't about race, this is about the exercise of powers of coercion and the primary means of constraining that, which is the ability of the subjects of that coercion to exercise a vote to change those exercising that power.

If Iwi Representation were required to enlist electors that are iwi affiliated, removing them from being able to vote for other Councillors (and indeed with numbers of Iwi Representatives proportionate to population of iwi affiliated electors), it would be completely different. It would simply be redesigning Maori wards to fit that model. The same in Parliament. 

If Maori seats were simply redesigned to be selected by Maori voters voting for representatives by iwi (and then there being some system to elect the appropriate representatives across multiple smaller iwi), it would also not be a problematic in applying liberal democracy.  However, if some MPs were just appointed, it would be undemocratic. 

Consider that Myanmar adopts this model, except it is the army that appoints MPs. 

Why do this?

Supporters of the legislation see it as implementing the Treaty of Waitangi, under the interpretation that the Treaty is not just about granting sovereignty over taonga and governorship to the Crown, but about a power-sharing relationship between the Crown and iwi (an interpretation that was largely confined to academic and radical political circles until the 2000s). 

If the Crown, represented by the liberal democracy of the New Zealand Parliament were separate and excluded Maori (as repulsive and Rhodesia like that would be) then this interpretation may have merit. Yet it does not exclude Maori, Maori have the same voting rights as everyone else, and both Maori and non-Maori vote for MPs who are Maori (and non-Maori).  In other words, Maori are represented in Parliament, their views are heard, and communicated by the MPs they elect, both from the Maori roll and the General roll. They are equal in their exercise of power to everyone else. 

Beyond that, consultation and engagement over public policy is extensive and is entirely within the role of a liberal democracy and for consultation with iwi to be treated as being part of implementing the Treaty.  Consulting Mana Whenua is entirely right and correct for local and central government, but when it comes to choosing who gets to exercise the monopoly of the use of legitimised force - through government- it should NOT be determined by unelected people.

For better or for worse, every single MP in Parliament, and up till now, every single Councillor in regional councils, territorial authorities and unitary authorities (et al) have their authority through public endorsement at the ballot box. The worst form of government every devised, except for all of the others tried throughout history, as Churchill was purported to have said.

Sure, I think most central and local politicians are utterly hopeless at defending the rights and freedoms of the public and private property rights, but their power is constrained by the ability of sufficiently outraged electors to throw them out of office.

Unelected politicians do not have such constraints. Be suspicious of anyone who is appointed to exercise legislative and tax raising powers.  

Environment Canterbury disgraces itself by actively seeking to weaken the power of its elected Councillors in this way, and Labour, the Greens and Te Pati Maori have all shown themselves to be parties in enabling this to come to pass. Imagine if Federated Farmers had appointed representatives on rural councils, or Chambers of Commerce on urban councils etc. 

Any future government should explicitly prohibit any local authority from appointing anyone to have voting rights in Councils or Council Committees without having been elected in local body elections, at a bare minimum.  

What's the alternative?

The role of liberal democracy in New Zealand needs to be able to be debated without the kneejerk reaction of "racist" from unreconstructed leftists and ethno-nationalists who want to shut down debate using pejoratives. 

Those who think mana whenua do not have a role in being consulted on local and central government matters are not helpful, because if the Treaty is to work in the context of a liberal democracy, then engagement and consultation is essential. However, mana whenua should not expect to exercise direct political power to erode or undermine the wishes of directly elected representatives of all electors in New Zealand (especially since they too get to choose those representatives).

Those on the radical left who think this is "white supremacy" and "neo-colonialism" ought to put up their models for a form of government, and have them subjected to scrutiny as to whether or not they can protect the rights of all individuals from unbridled power and the corruption of power which is much more likely under systems of those appointing people with power.  After all, the UK retains the House of Lords, with appointed politicians, who scrutinise and delay legislation (although they cannot stop it), as a hangover from a very much class supremacist view of government.  New Zealand should not replicate this sort of political structure.

After all, liberal democracy is now the dominant form of government in most of Asia, Africa and the Americas, and frankly it is only autocracies like the People's Republic of China, the Islamic Republic of Iran and Turkmenistan that question the validity of governments that are constrained by secret ballots and the essential, concurrent freedom of speech and the press. 

Have mana whenua consulted, include them on informal committees and boards used to advise Councils and Government.  Government and Councils can also include them in co-governance of assets or systems if they wish - the whole debate on Three Waters co-governance is entirely legitimate (sure I don't agree with the proposal, but everything local government does is entirely at the behest of Parliament, which grants local government its power, it is still fundamentally accountable to electors).

The co-governance of Urewera National Park and the Waikato River are enshrined in Treaty settlements, and there is no conflict between any of this and a liberal democracy, because elected MPs agreed to it.  

In liberal democracy power IS shared, between representatives by geography and representatives by political ideology and philosophy, and when enough electors tire of one lot, they replace them with a new bunch. Does it achieve much? Often it doesn't, but it does achieve one thing - it means that all of them fear causing so much disenchantment that they lose government or worse of all, lose their seat in power.  Ngai Tahu and all Iwi ought to value that, and ought not to be immune from it.

UPDATE: So Tamati Coffey is inviting other iwi to consider "this path" to better representation.  He introduced the Rotorua rorting local elections District Council (Representation Arrangements) Bill, so he's showing his colours around corporatist government. Maybe it would be better if the former TV presenter simply abandoned representative democracy altogether if he doesn't believe in it?

Submit today on the Rotorua District Council (Representation Arrangements) Bill

David Farrar's Kiwiblog has an excellent submission on this absolute travesty of basic individual rights and liberal democracy.

This debate about this issue has been muted. Stuff reports it, with taxpayer funding from NZ On Air, without ANY discussion about the implications for liberal democracy.

What is proposes is a form of racial gerrymandering that means that Māori Ward Councillors on Rotorua District Council will represent fewer people, but with the same amount of power as General Ward Councillors. 

As Farrar says:

This bill would give the Māori ward three Councillors for an electoral population of 21,700 and the General ward three Councillors for an electoral population of 55,600. This means the vote of someone on the general roll will be worth only 39% of the vote of someone on the Māori roll in terms of Ward Councillors, and 58% in terms of the whole Council. 

It debases the votes of non-Māori ward voters, and for what? To seek to equalise representation not on the basis of counting heads, but by valuing the votes of Māori ward voters 2.5x more than non-Māori ward voters.

Let's apply this to Parliament?

Extend this to Parliament (assuming no change in the number of seats) and the result would be this:

General Electorates: 36. 1 MP for every 89958 voters

Māori Electorates: 36. 1 MP for every 7591 voters

In essence it multiplies Māori roll votes 11 fold compared to non-Māori. The exact impact on Parliament is difficult to forecast for multiple reasons, as no doubt there would be more candidates, but also the impact on emigration (let alone immigration) would change the demographic as well (some advancing this policy would like that). 

It could be assumed that the majority of Māori Electorates would vote Labour, and some would vote Te Pāti Māori, maybe one or two could go Green or even NZ First.  

How would that affect the list seats? It is entirely possible to leave them as is, with one person one vote and let proportionality come to play, but that is likely to create an overhang. Let's say based on the current Parliament, that one in seven of the Māori electorates go to Te Pāti Māori, which would mean it gets 5-6 seats. Even if it got double the party vote of 2020 (which would be 2.34%) it would only be entitled to around 3 seats in Parliament, so Parliament would grow by 2-3 more seats in total.  Advocates of such a change might say the overall impact would not be significant, because ultimately National would get most of its MPs from the list, so proportionality might be retained overall, but the effect would be dramatic.

Moreover, if you can argue for electorates that require 11 general roll voters to elect an MP, but 1 Māori roll voter, then you can argue that Māori party voters get the same magnification of impact.

and that would truly be the end of liberal democracy as we know it, and is internationally recognised on the basis of one person one vote.

This sort of gerrymandering is seen in corrupt democracies, which try to construct constituencies that have small numbers of politicians representing large numbers of people who politicians want to reduce the franchise for, with higher numbers for the preferred group.  During the dying days of apartheid, the South African Government argued for its democracy to enable white South Africans to have a veto of decision making over the black majority.  This was rightly decried as racist and unacceptable. Going from total white minority rule to white minority veto was not advancing the rights of all South Africans.

However, there is a movement in Māori politics that is antithetical to liberal democracy and individual rights. Te Pāti Māori MP Rawiri Waititi said it clearly when he thought Aotearoa had a great future "but not necessarily as a democracy". 

It isn't exactly rude to ask if the Green Party of Aotearoa or the New Zealand Labour Party share his view. 

Now I'm highly sceptical of liberal democracy as a tool to protect individual rights, and Waititi is dead right when he raises concern about majority rule. Unfettered democracy does enable mob rule and does enable injustice, but the contraints on this should be constitutional to ensure basic rights are not overriden. I have a lot of sympathy for calls for tino rangatiratanga for everyone.

However, nobody advancing this change is caring remotely for the rights of individuals to peacefully go about their lives, this is about advancing power, albeit at the local government level, to regulate and tax people's property and businesses.

You have only a few hours to express your opposition to this racist travesty of a Bill, that has NOT been advanced by the local MP Todd McClay but rather Labour list MP Tāmati Coffey.  Labour, the Greens and Te Pāti Māori are all advancing it.

It deserves to be voted down in flames, and it deserves your submission in ardent opposition to it.
